Knowing which older education rules still apply

Resolution 30/2026/NQ-CP · Continued application of earlier decrees

What this means for you

  • The new education laws did not make every older implementing rule disappear; specified rules continue with exceptions.
  • An older official compilation is not a complete statement of today's requirements. Match the activity and article to later changes.
  • For branches and joint programs, check the current procedure and any saved-file protection before relying on an old approval.

Questions about how this applies to your institution? Talk it through with a USVN senior advisor.

The detail

1. The rule and its status

Specified older education implementing decrees continue after the new laws, subject to exclusions, consistency with current law and later replacement. In force, subject to later instruments: issued/effective June 16, 2026. Official register; official Annex II.

2. Who it affects and what it means for a US school

This matters whenever an older decree is cited in a 2026 partnership. Neither “the new law repealed everything” nor “the old decree is entirely unchanged” is a sound reading. Annex II continues86/2018 as amended by 124/2024 with listed exclusions and procedural changes. Its foreign-branch rows point to Resolution 23's procedures at that stage; the later361 regime must now be included.

An official consolidation dated before these changes is useful historical evidence, not a current article-level legal opinion. The actual activity, current provision and transition facts must be matched.

3. What to do, by partnership model

  • Recruitment: identify the applicable consultancy/representation rule and later simplification. Do not use continuation of 86 as proof that an old recruitment business certificate is still the universal route.
  • 2+2/3+1: retain the linkage-versus-credit-mobility classification and check the surviving program provisions against the new law and circulars.
  • Dual degree/joint program: use the continued provisions only to the extent consistent with current law and exclusions. Confirm the current institution-specific decision route; do not assume a universal ministry-approval or self-approval rule.
  • Online/blended: reconcile surviving decree assessment requirements with Circular 07's mode definitions,49's technology obligations and 65's recognition conditions.
  • Branch campus: use361 for new establishment/operation files. The resolution's earlier referral to 23 cannot revive provisions later ended by 361; saved files need their own transition analysis.

Maintain an article-level record of “continued,” “excluded,” “later repealed” and “saved case” with dates and sources. This is an editorial diligence method, not a new legal reporting requirement.

4. Change history

The resolution bridges the earlier implementing framework to the 2026 laws. Annex II, printed pages 6–13, contains the foreign-cooperation exceptions checked here. 361 Article 41(2)(đ) subsequently removes specified foreign-HEI/branch 86/124 content from September 17, with Article 42 transitions. The September foreign-cooperation proposal may change more if enacted, but its announcement is not an enacted replacement.
